These terms are a binding agreement between you and NQ Heads ("we", "us"). By using the website nqheads.com, joining a plan, starting a free week or reading any signal or alert, you accept these terms, the Risk Disclosure, the Privacy Policy and the Refund Policy. If you do not accept them, do not use the service.
NQ Heads publishes information about E-mini Nasdaq-100 futures (NQ): trading signals produced by automated strategies (an entry, a stop, a target and an exit, and a daily summary) and educational market alerts. The same information goes to every member of a plan at the same time. It is impersonal: it is not based on, and does not take into account, your finances, objectives, experience or account. We do not place, manage or execute trades, we do not hold money or securities, and we do not have access to or control over any account.
Nothing on the website, in the channels or in any message from us is investment, financial, trading, legal or tax advice, an offer, a solicitation or a recommendation to buy or sell any instrument. We are not a broker, a futures commission merchant, an investment adviser or a commodity trading advisor, and we are not registered with any financial regulator. No advisory, fiduciary or client relationship is created between you and us. Speak to a licensed professional before you trade. The information is general and is not a substitute for advice that takes into account the personal data and needs of each person. Personal interest: the people behind NQ Heads may trade the same instrument, including in the same direction as a signal or the opposite one.
You use the service entirely at your own risk. You alone decide whether, when and how to trade, with your own broker and your own risk settings. You accept full responsibility for every trade you make or do not make and for all of its results. You confirm that you have read and understood the Risk Disclosure, and that you trade only with money you can afford to lose.
Every signal, alert, statistic, figure and summary we publish describes past market data or how our automated rules behaved on past data. None of it is a prediction, forecast, promise or representation of what will happen in the market or of any result you will achieve. Markets change, and patterns that held in the past may not hold in the future.
You must be at least 18 years old and legally allowed, where you live, to receive this information and to trade futures. You may not use the service from a country or region where it is unlawful, or if you are subject to sanctions. You are responsible for complying with the laws that apply to you.
Plans are sold and billed by Whop, our checkout and membership provider, under Whop's own terms. Consensus, Trend & Fade and Live Combined Plus start with a 7-day free week; if you do not cancel before it ends, your payment method is charged and the plan renews every month. C90 and Learn have no free week: they are charged when you join and renew monthly at the price shown at checkout. Promotional prices apply only for the period stated on the website. We may change prices for future billing periods; the new price applies only after notice.
You can cancel at any time in your Whop account. Cancelling stops the next renewal; access continues until the end of the period already paid. See the Refund Policy. If you open a payment dispute or chargeback without first contacting support, we may end your access.
Your access is personal, for your own private use, and for one Telegram account only. You may not share, forward, copy, screenshot for others, resell, publish, broadcast, post in any group, channel or social network, use to trade or automate trading for anyone else, or otherwise distribute any signal, alert, chart, summary, image or other content, in whole or in part, during or after your membership, and you may not share your account or access. Content may carry identifying marks that allow us to trace its source. All content, strategy names, codes, images and the website are our property or used under licence. If you break this section we may end your access immediately and permanently without refund or notice, and you are liable for all harm caused, including at least the fees that every person who received the content would have paid for the plan for the period they received it, and our reasonable costs of enforcement.
Results shown on the website, in the channels or in any material are simulated on historical one-minute NQ data with assumed costs deducted, unless clearly stated otherwise. They are not the results of real trading and are not a promise or a forecast of future results. Hypothetical or simulated performance results have certain inherent limitations. Unlike an actual performance record, simulated results do not represent actual trading. Also, since the trades have not actually been executed, the results may have under- or over-compensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated trading programs in general are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown.
The service is provided "as is" and "as available". To the fullest extent allowed by law we make no warranty of any kind, express or implied, including about accuracy, completeness, timeliness, profitability, fitness for a particular purpose or uninterrupted availability. Signals and alerts can be delayed, missed, duplicated or wrong because of data feeds, software, platforms, internet connections, Telegram, Whop or other causes outside our control.
The strategies are researched and refined continuously. We may change, add, pause or remove strategies, channels or features at any time. We may also stop any plan, or the whole service, at any time, immediately and without prior notice. If we stop a plan, we cancel its recurring billing at the same time, so no further payment is charged for it; access ends when the plan stops. Any refund for the current period is at our discretion, except where mandatory law requires otherwise.
To the fullest extent allowed by law, we and the people behind NQ Heads are not liable for any trading losses, lost profits, lost opportunities, or any indirect, incidental, special or consequential damages, however caused and even if we were told they were possible. Our total liability for all claims of any kind is limited to the amount you paid us in the one month before the event giving rise to the claim.
You release us from all claims arising from your trading decisions and their results. You agree to indemnify and hold us harmless from any claim, loss or cost (including reasonable legal fees) arising from your use of the service, your trading, or your breach of these terms or of any law.
Before starting any claim you agree to contact @NQHeadsSupport and try to resolve the issue informally for at least 30 days. Any claim must be brought within one year after it arose, or it is permanently barred. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective or representative action.
These terms are governed by the laws that apply to the operator of NQ Heads, without regard to conflict-of-law rules, except where the mandatory law of your country of residence requires otherwise.
Whop, Telegram, payment processors, brokers and data providers are independent third parties. Their services are governed by their own terms and we are not responsible for them.
We may suspend or end your access at any time if we believe you have broken these terms, used the service unlawfully, or harmed us or other members.
If any part of these terms is found unenforceable, the rest remains in force. Our not enforcing a right is not a waiver of it. These terms, together with the policies named in section 1, are the entire agreement between you and us about the service. We may transfer our rights and obligations to another entity that operates the service. We are not liable for any failure or delay caused by events outside our reasonable control.
We may update these terms. The date at the top shows the latest version. Continuing to use the service after a change takes effect means you accept it.
